silly question

    i received a summons and complaint from an attorney some time ago that was sent in reference to a rent debt that was at least 5 months out of the sol in the state it occurred... note that neither this state(the one i live in) nor the state that the debt was incurred have a tolling statute....

    so i answered the summons with some downloaded forms and explained that sol had expired...all nice and legal ( i think)....

    so anyway...my question is this........

    are either the company or the attorney liable for any damages for pursuing a debt through legal action that is clearly outside of the sol?

    Depends on whether you raised taht issue as a COUNTERCLAIM.
