Slightly OT, but relative re: bank

    Sorry for the slightly off topic post but I thought you guys would probably have the answer. You are all so smart! (brown nosing?, no not me:) ) My ex DH has our auto insurance premium automatically debited from a checking account each month. His account was a bit low and the bank paid the debit but charged him a NSF of 42.00. He hasn't been bouncing checks. Is this legal. Isn't there a limit on finance charges via usuary laws? The bank he uses rhymes with schmee- of -hay.

    Hoping to get it reversed. Any ammo out there to quote when talking to CSR at Bank Of A...

    When you say his account balance was "a bit low":

    Do you mean that there wasn't enough money in his account to cover the auto dedection?

    Are you saying that he went below a specified minimum balance?

    Was he waiting on a deposit to be made available?

    HI,

    His account had 278.00 balance. The auto premium was 285.00. They paid the debit (B of A) and charged him the fee for covering it. I can understand a 10-15.00 fee, but over 40.00,that is a bit ridiculous.

    He has had the account for about 11 years. And he doesn't bounce checks. Hasn't bounced any in years and is responsible with his moola. He never has had a problem bouncing checks, perhaps 2 over the last 10 years because of not balancing his checkbook correctly. I told him to call CSR at BOA and ask for a courtesy removal of the fee.
