Small Claims Court against CA

    How hard is it to sue a CA in small claims? Also, what is the maximum you can sue for in small claims?

    I have two CA's that have never responded to any of my certified dispute letter, so I want to file suit against them for violation of the FCRA, as they continue to report negative information on my credit report.

    Should I purchase one of those $15 do-it-yourself small claims kits? I have no idea of how to start. Any suggestions would be appreciated.

    Are the green return receipt slips enough evidence to support my case?

    You need more than a failure to respond to your validation requests. They, however, can no longer actively collect on this debt until they respond to your validation request.

    Did they mark on your credit report "consumer disputes debt?"

    If not you may have them on a violation of FDCPA.

    Did you dispute with CRA after they rec'd your val request?

    I have the same problem and they haven't marked "consumer disputes debt" on my report. If I file small claims against them for this, will they likely just delete the mark in return for me offering to drop the case?
