Small Claims for unauth inquiry???

    I got my response from Verizon LD today, and basically they apologized and said if I wanted to file a claim against them that is my right. I am very disturbed with their nonchalant approach to customer service.

    Anyhow, this am I called the Franklin County Municipal co court and explained what occured and the clerk said in order to file in small claims and succeed you have to prove monetary damages. I don't intend on applying for new credit just to make the case work, so I read the FCRA for civil liability for knowing noncompliance regarding inquiry worth 1,000.00. But he didn't seem impressed, and wasn't convinced that I would get deletion and/or $1,000.00 as he said, sir but what monetary damages have you sustained as to which honestly I answered none as of yet. He then proceeded to tell me that I am welcome to file if I wanted to pursue-is it best that I do in small claims, or should I see an attorney specializing in FCRA cases-I actually found one in the Columbus Yellow Pages.

    Please I am asking for any help I can receive, I hate the smug attitude of the Verizon Long Distance people. The supervisor handling my claim said she forwarded the information to their Billing Resolution Department and I see that no outcome came of that, has anyone had any experience with Verizon and whom I may need to talk to??????

    personally, i feel like dropping verizon, i only have them for local, i use calling cards for l.d., but vz wireless has scammed me, and i don't do business with scamsters!!!

    I went the next step and filed a complaint online with Attornery Jim Petro's Department for consumer protection. I have been assigned a case specialist and hopefully someone will understand this is unlawfull for verizon to pull a credit report and do what they have done. If anyone can provide more info on small claims court in Ohio, Columbus the information would be greatly appreciated.

    I filed in small claims court for PP against Cavalry Investments. I am in Cincinnati, Ohio, Hamilton County (court date is May 8th). I spoke with Charlie Deters, the Cheif Deputy and he said that it was the correct court. I even told him that I did not experience actual damage since it was a A/R not seen by anyone but me just the violation of the FCRA. My friend who is a lawyer said it was the correct court too, but that if they didn't settle, they would probably have it moved to municipal court since Corporations in Ohio HAVE to have an attorney appear in court, not just a company rep.

    I am no expert, so PLEASE, don't take my word as law. But that is what I have been told to date.

    Hey kak, I'm in Cincinnati too. Think I'm going to have to go this route for some unauthorized hard inquiries, so this is definitely going in my saved threads file. It's a place to start, anyway. :)

    OK Thank You so much for your words of wisdom--it will only cost me 47.00 to file in small claims court, but my next question is this: When I called to get information Small claims is in the municipal court building here in Columbus, OH Franklin County, so does that just mean small claims is a separate court from the municipal court and just resides in the same building? That's where I am confused, and basically when I read the FCRA to the person answering the phone all he could say was but to get the money you have to provide that you have sustained damages, so I figured he didn't understand the law? Correct me though if I am wrong, even though I didn't sustain monetary damages, I should still have the right to pursue it legally on the fact of Verizon's non-permissible purpose correct? I might be cloudy on this as I have never had to go this far, and really its basically for whats right and Verizon Long Distance invaded my privacy and that isn't right.

    Questions comments or helpful suggestions are always appreciated.

    Yes, I believe they are different courts, same building. Here is a link to a web-site that might help you. http://www.fcmcclerk.com/General/general.html Hamilton County had a similar web-site I found helpful. Maybe you could speak to someone higher up at the courthouse to verify that it is the correct court, but I think we are okay. I was worried about the same thing you were, as far as sustaining damages, but as I said, the Chief Deputy told me it was fine, so I'm going on that. Let me know if you find out differently. Again, if Verizon does let it go as far as court, they will probably have it moved from Small Claims, as corporations in Ohio are required to have a lawyer present, even in Small Claims. So, there is no benefit for them to keep it in small claims, and it hurts you NOT to have it in small claims (less relaxed atmosphere and you might have to hire a lawyer if it gets moved from Small Claims.) Hope that helps.
