Small claims question

    Hey all, I've been a long time participant on this board, it's really helped me. Thank you all for sharing your knowledge and experiences. I have this CA: "Profesional Credit" aka "Professional Credit Service," hq out of Oregon, that I've been battling for some time to remove an invalid collection from my files. A few years ago, I sent validation ltrs and they finally dropped TL from the report (only TU). Of course, I dropped my pressure campaign and moved on. A few months ago, my credit monitoring flagged me and showed they had reported it again after not validating! (I know, should have got something in writing, but they were so non responsive. I wrote another validation letter reminding them of their violations from a few years ago. They responded w/ a ltr stating that it was validated back then during the time I requested validation (big lie). At this point, I need to sue in small claims.

    I live in Ca and I'm having trouble finding this CA as a legal Corp. or LLC doing business in Ca. According to the CA's website, the official company name is Ray Klein, Inc. Joe Hawes is CEO. California shows no record of these people doing business in Ca. but obviously, they do. How can I serve them w/o going to Fed. court? small claim court requires that the serving agent be in California. If they do not show an agent, but are doing business here, what recourse action do I take to serve them?

    Is this an account that was yours with erroneous information posted to your CR (balance when it was in fact paid, etc.)? Or is this someone else's account, that you are not responsible for, that they are trying to collect from you?

    Did you dispute thru the CRA? If this was removed due to a dispute thru the CRA, they should have provided "certification" to the CRA on reinsertion.

    If they "validated" as they claim, why did they remove their tradeline?

    ontrack, thanks for the reply. Actually, the original TL was only on TU. They have recently reported it to EQ.

    The account in question was a previous bank acct that I closed years ago. There was no balance when it was closed. I have yet to receive anything showing where and how a balance was made.

    This Professional Credit does not respond to validation so I think they'll have to respond to a judge.

    Did you check with the bank?

    Professional Credit appears to value its professional image, based on a clean BBB report, and the activities of some of its key people. You may have to proceed to legal action to get the matter corrected, but you might simultaneously file complaints with Oregon AG and BBB to get their attention. If they are falsely claiming to have "validated", or to have no responsiblity to provide you anything on this debt, say so.
