SO let me get this right...

    I have read and read and read some more, and the info here is invaluable, but before I do this I want to be completely sure that when some one does a Non PP, I just send them an ITS because it is an automatic violation?

    Depends on what you are after...

    If its deletion, just call the CRA :)

    If its $ from a lawsuit, dont INTEND to sue...SUE....(UNLESS YOUR STATE REQUIRES INTENT NOTICES)

    And I dont necessarily have to have damages, right?

    Credit reports can be used for a number of valuable, yet illegal, purposes. You could obtain enough information to make it easier to steal someone's identity, or commit other fraud. You might be in some dispute with someone, or be negotiating to buy their house, etc. Knowing their financial position could help you know how far to push to get a better deal, etc.

    -You are correct:)

    -It is called a "strict liability" statute. YOU MAY HAVE TO EXPLAIN THIS TO THE JUDGE THOUGH :)

    -Case law and FTC opinions abound on this if you need them for court.
