So so lost...please help!

    Hello,
    My husband and I are in the process of filling out our bankruptcy worksheets. My husbands' debts are all (except for his auto loan) anywhere from 5-10 years old and most have been re-aged.

    How do I get the addresses for the CA's? They are not on the credit reports and he doesn't even know if they are his or who the original creditor is!

    Even the last 4 digits of the acct. numbers don't match up with anything that could be an OC...even with the same creditor's name, the CRA's have different numbers listed.

    What a nightmare!!

    Some examples are:

    Asset Acceptance LLC
    PDI Management Services
    National Collection
    RJM Acquistions Funding

    Any help would be sooooooo appreciated.

    If they are this old they might be past the SOL for collection. Is this the only reason for filing BK? If so, you may not need to file!

    Send the Validation letter to each CA, if you don't know the address then call the CRA and ask them for the address of the CA reporting on their report

    Hi,
    We are in PA and I am filing because I can't keep up with the CC payments anymore that are in my name. He is filing all because of the old debt. All he has added on his credit report in the last 5 years is our wedding rings that he paid on time and his car loan, also paid on time every month for the last 3 years.

    Everything else is 5 years and older. I know it would all be past the SOL but they have everything re-aged. He desputed a few through one of the CRA's and they said they were verified and the CA's updated them to 7/04. He just figures he's screwed with these CA's. He can't prove anything and doesn't even know what they are from...could be an ex who he hasn't heard from in 7 years but there's no way to find out.

    I would rather he didn't file because even with the ugly stuff on his report, he has a few good things there too and Experian scored him at a 637 which isn't great but it's not bankruptcy!

    Transunion also deleted 4 items but he thinks they will just sell them to someone else and they will be back on his Credit Report.

    I don't know what the right answer is but this paperwork stinks!

    He should be using the formal request for validation found in the sample letters section
    The CA's must prove what they are reporting to the CRA's is 100% accurate, if they can't do that they must remove their TL!

    That is a good reason for him not to declare BK!

    Thanks so much for your input. I'm gonna sit him down tonight and try and talk him out of it. He's worried also about one of these re-aged accounts suing him and since he has no proof of anything, it scares him.

    Read a lot of the old posts here for valuable information, and ask questions

    If they were to sue him they would have to have documentation to prove their allegations

    If he know for a fact that these accounts are old and have been re-aged you stand to collect some money from these CA's for FDCPA violations!

    The validation procedure is your first step!
