Found I've got a very recent (5 days old) AR from Financial Collection Agency, 2675 Paces Ferry Rd, Atlanta GA from TU. Is it legit for a CA (I assume they are, based on their name to pull an Account Review when I have no ongoing relationship with them? I suspect not. I tried to find out who/what they were by calling, but their phone is bogus. Troubling. As far as I know, there's no reason for anyone to be chasing me for old debts, as I did a Ch7 two years ago. So I guess my question is - if a CA has you in their site, how does that show up on your CR? They can assert there is a debt outstanding (for now), so they presumably have PP.
I, too, have an AR from these people on my TU cr. In my case, the AR appeared last December. The phone number was disconnected. Googling the address brough up nothing. I tried to get more infor from TU...they were not interested in helping. It's seems that TU has some liability here, but I never pursued it. The fact that this company is still doing this is rather disturbing. What do you think you are going to do?
Here's the letter I just wrote: Financial Collection Agency 2675 Paces Ferry Road Atlanta, GA 30339 October 28, 2003 To whom it may concern, During a review of my credit files from TransUnion I was troubled when I found an inquiry posted by your company on October 20, 2003. The type of inquiry is an â??ARâ?, which means an account review. That implies I have an open account with your company, yet I donâ??t recognize your companyâ??s name. In fact, the phone number given to me by TransUnion does not function (404 333.6600) and your company is not listed in the white pages at the address above. I hope you can clarify this mysterious open, ongoing account I have with you. I look forward to your clarification and your timely response in this matter. If I donâ??t have an explanation for our â??relationshipâ? in fifteen days, I will pursue my options for financial compensation (minimum $1,000) under FTC regulations in court. dans XXX Some Road Somewhere Somestate 00000 CC: TransUnion Sent Certified Registered Receipt #XXXXX -------------------------------- I cc'd TU and wrote an additional note alerting them that this subscriber should be validated, as the phone number does not work and is not listed.
I hope you'll keep me posted with your experience. I googled the address after I found the phone number was bad. It is a building with many, many suites. It will be interesting to see if they can find the right business.

Good point, but the train has left the station. I'm sure I won't hear squat from them, so I'll put them in my pile of $1k lawsuits. I've got about five so far, the judge is gonna love me...

Any update? DanS - Do you have any update on your PP letter to this company? Could the letter be delivered based on the info TU provided? Also, searching this board, I noticed Experian has an office very close to the address of this mystery company: Experian 945 East Paces Ferry Road Suite 2600 Atlanta, GA 30326 Phone: 800/831-5614 Fax: 404/841-1458 Website: http://www.experian.com It's probably just a coincidence...

Any update? Dear Dan, Read your thread on Fin Coll Agency. Have the same problem with them and TU. Whatever became of your complaint with TU? Did you find out who they were? Did you sue anyone? Please let me know. I don't think TU should be allowed to get away with this.
Re: Any update? Katwoman - please drop me an email by clicking on my name above, and selecting the email option. Thanks.
"Soft" inquiry -Never get that. ANY INQUIRY, whether "hard" or "soft", claiming an "AR-Account review", IS AN INQUIRY ALL INQUIRIES ARE INVASION OF PRIVACY. PERMISSIBILITY OF THE INQUIRY IS THE QUESTION. "if a CA has you in their site, how does that show up on your CR? They can assert there is a debt outstanding (for now), so they presumably have PP." -Because the colleciton agencies are "subscribers", and per the "agreement" EACH OF THEIR PULLS ARE PRESUMMED permissible by the credit reporting agency. "so I'll put them in my pile of $1k lawsuits." -Dont wait too long Additionally, there is a case that says if they do not reply to the request for the permissible purpose, it can be assumed there was none. BUT that is assuming they received the request. -THE credit reporting agency IS NOT liable for the impermissible access UNLESS they were "made aware" and did not do anything about it. "TRIED TO CONTACT THEM FIRST--NAME AND ADDRESS ARE BOGUS--PLEASE REMOVE" -Assuming this was in a dispute letter to the credit reporting agencies, IT WOULD BE REMOVED AS A RESULT OF A "goodwill gesture", and that who the request should be approached. "Include a copy of the CERTIFIED LETTER ENVELOPE WITH "ADRESSEE UNKNOWN" SHOWING..." -Cant hurt...BUT better saved for court evidence. Because the credit reporting agencies rely on the "contractual assumption" that each pull is permissible, the consumer being unable to contact the colleciton agency is of little interest to them.
false certification = impermissible = failure to verify identity Nice post, I would be interested in that cite or just the parties if you have it on the top of your head. Anyone know a MOD here? I need a little flavor. btw, and not a know it all by any means, but have been dealing w/this particular case for 6 weeks, building it...good way into it is Sect 609(a)(3) request and if CRA can't comply with that it evidences Sect 607(a) failure...the CRA should be able to find out or it "should" be discoverable who is paying the bill on that subscriber number. You should have heard this TU rep asserting the privacy interest in the subscriber # while withholding the identity of the "customer" CA. I thought well "Whose privacy are you TALKING about??" lmao "parroting" PURELY FALSE IDENTIFYING INFO is what we have here. Not sure courts have seen this one on such a high level of knowingly and willful, purposeful deceit...and it is built.
Dan, also enter that Certified tracking # into USPS.com I am one step ahead of you, player, but this is my full time job. Proviing up the false address is not a problem. The DBA is not an existent one in Georgia, that is the shortest route, not to mention the nonworking phone number. Hey man...that false phone number was a big piece..they wouldn't even give me a false tel number, no fair.
