Soft inquiry after loan is paid off

    Dear Sir or Madam:

    In reviewing my Experian credit report, I noticed that Providian obtained my credit report on 11/10/2001. I did not apply for credit or employment with Providian and to my knowledge, I had no business relationship with your company. I therefore have not given you a permissible purpose to request my credit history.

    I have done some research regarding the Fair Credit Reporting Act. I'm dismayed that you would pull my personal information without my knowledge or permission.

    I found the following information under 15 U.S.C. §§ 1681N "Civil liability for knowing noncompliance. Any person who obtains a consumer report from a consumer reporting agency under false pretenses or knowingly without a permissible purpose shall be liable to the consumer reporting agency for actual damages sustained by the consumer reporting agency or $1,000, whichever is greater."


    This provision says that they will be liable to the CRA but it worked for Christine Baker on Wells Fargo.


    Please explain your permissible purpose for obtaining my credit report. Should you not have a permissible purpose, please arrange for payment of $1,000 by 2/10/01 or I will be forced to file suit for this invasion of privacy.

    I think the section you want to quote is this:

    It doesn't get much clearer than that.

    Indeed, they are probably liable to BOTH the consumer AND the CRA.

    Just pulled my cr after my auto loan was paid off...account is now 0 bal, but I see they did a hard inq. Whats up with this??? The hard was done AFTER the acct was paid n full.

    I think they just wanna know who has your new loan, as if the payoff check would not tell them, they know who they sent your title to as well, lol.

    Questions

    Ok, I sent a $1k demand letter to their legal dept. They're ignoring me. Should my next letter be an ITS? Should it be addressed to their registered agent?

    AR on closed end loan

    They pulled a AR every month for me before I paid them off wonder if I can get PP as it's a closed end loan considering the Gowan opinion
