This is a great source of information, thanks to all who participate....
I've been reading several posts and have done a few searches but can't seem to get an answer to my situation.....Maybe someone can help me!!!
Got served yesterday Feb. 21 due to go to court on March 22nd, the last payment on the account was March 15, 2003 so the statute of limitations runs out in Florida after 4 years which is before I appear in court but after I was served.
Which date would the court go by if I scream SOL!!!!!!

Thanks in advance for your help.

Probably the date they filed, which if you were served, has already happened.

thats correct, if i remember correctly, as long as the lawsuit is filed and served properly before the SOL runs its valid.

The answer to your question can probably be found at http://www.fdcpaexpert.com/floridasolannotated.html

You will also find a link to the actual florida statute of limitations in PDF format which is located on a Florida State Government web page.
