SOL in Illinois

    Hello,

    I live in Illinois. I received a perking ticket from my village in 1998. That same year I filed for bankruptcy. The ticket was sent to a collection agency. It was later put on My credit report. It was later removed. It has since reappeared. Has the SOL ran out? What can I do?

    I'm guessing that you filed BK *AFTER* the date of the parking ticket? Right?

    Regardless you could demand validation. Continued collection of an account prior to the date of BK would be illegal.

    Of course, it's old enough that you might just get lucky and dispute would knock it off your CR.

    Aside from the credit issue, it affecting your credit report is the least of your issue here. If you don't pay the ticket, you risk them suspending your license. Also, at least in the states I've lived in, they can and do tack on interest.

    I'd vote for just paying the ticket THEN dispute it off of your CR.

    Thank you for the replies. The ticket was before the BK. I understand Shanyl says to pay the ticket but how do i guarantee they will take it off of my credit report. Is there any letter I should send? Any other solution?

    Is there any way that your BK lawyer would be willing to write a letter stating that the unlisted debt did not survive your NO ASSET Bankruptcy (if it was no asset)?

    I wrote that letter recently myself, and got an OC to release the CA. (more to the story, but short version).

    Parking tickets are a Governmental obligation and are not dischargeable in BK.

    Pay it.Send a money order directly to the town, NOT to the CA.
    Opt out
    Wait 2 weeks.
    Delete your old addresses
    Wait 2 weeks
    Dispute it as "not mine, no such account for this creditor in this amount for this date"
