SOL question

    Is an aprtment lease considered a "written contract?"

    Also, would the SOL on a lease start when the lease was signed, or the date of the apparent delinquency? I have a collection account from an apartment I lived at in 96-97. The lease was signed in August 1996, but the supposed delinquency was in July 1997. I thought I read online somewhere that the SOL is started from the signing date, but I was not sure.

    I think so, since like most contracts, it locks you into certain agreement terms for a certain amount of time.

    Yes, a lease is a written contract. However, there is a seperate section conserning leases in the UCC that contains more specific information about these types of transactions.

    The SOL is from the dat e of default. In other words, from the time you didn't abide by the contract, ie breach, didn't pay the rent.
