SOL Question

    I checked the unofficial FAQ (great listing by the way) and didn't seem to see an answer to my question.

    I am a newbie here, attempting to rebuild my credit. What I need to know is what state's SOL apply? In other words, in my case the credit was obtained in FL, the company the gave me the credit is HQ'd in NC but I currently reside in CA. Which SOL applies?

    Either one can apply. The creditor will sue you in the state that he/she can. In otherwords, in the state where the SOL has not yet run out.

    If they choose to sue you in a state that you no longer reside, you would have to petition the court to have the case moved to your current state.

    OK, thanks for the quick response.

    My next question is this. I have some very small ($50.00, $180.00) bills that are too small for a suit IMHO. Can I offer to pay them in full if they will agree to delete them from my record?

    How would I go about doing that?

    Sure. Be careful, and get everything in writing.

    They can file suit in either Cal. or Fl.but NOT IN N.C. -You would still have to be served in Cal. so they would file suit there anyway. They would have to obtain a Cal. lawyer to do it,if it is a cc debt, generally they won't bother under the State limit for small claims court.
