Just a quick question about SOL's. Is the SOL based on where I lived when I assumed the debt or where my current residence is? I'm asking because being in the military I have debts from more than 1 state and will be moving again very soon. most are from SC where I believe the SOL is 3 years, but if I move to FL this summer as I expect to, their SOL is 10 years.
I believe it has something to do with "tolling", and I believe that it's the state where the debt was incurred. You can try a search for "tolling" and possibly find out more info.
Thanks, I'll do that. I'd like to start cleaning up my reports, but if the SOL hasn't run out or will be extended based on where I get stationed at I cetainly don't want to go stirring up a bees nest. But if SOL has run out........
The SOL is based on where the claim is brought into the Court. You can be sued EITHER where you live, or where the account was taken out. Tolling has NOTHING to do with your situation. The SOL for CC debt in Fl. is 4 years- not 10. Fl. has fairly tough collection agency laws, total homestead exemption and no garnishment for the head of household
