Say you have a short period of time to wait out (less than a year) for SOL...has anyone ever sent an SOL ltr out anyway- (no validation-just SOL ltr) either mistakenly or knowingly? What were the reprucussions? Did the CA sue right away? Did they back off figuring you were a consumer who knew somewhat about their rights? Is this just a stupid question b/c no one would ever send an SOL ltr under these circumstances?
when you battle legally you must stand on solid ground. I would not bring up a SOL defense unless the SOL has actually passed. if you only have a few months to go then your strategy is to stall them and discourage them from filing suit until the SOL has run. request everything in writing , get validation from CA first!
