Does the SOL apply to the state where you now live, or where you lived when you applied for the credit? I now live in WI (5 yrs) but all my bad credit was acquired when I lived in MN (6 yrs). And is the SOL from the date of last activity? Thanks!
LKH and others ... What would a Old Apartment debt be called??? In 1997 they reported to CA for 200 pet deposit not paid when i left.. it' since has been reported with the Apt complex name... It hasn't stop me from renting thru the years, or when i got my Condo... My question is the SOL and what it would be considered as??? I'm going to stick it to this CA, because they're reporting and have been since then "Customer unable to locate Consumer"... Big lie they've sent letters and called througout the years... I've ignored their lttrs and calls... Now want to just get it removed now since finding this board.... Thoughts???
Don't quote me but I think the sol would be for the state in which the contract was signed or the transaction occurred. As for apts., I would think they fall under written contracts.
The SOL of the State they bring suit in, (or try to) is the one that applies. If they bring suit against you in your prior State, they have to serve you in your present one and you can appeal for a change of venue if they do so.
