Sol

    I have a question about SOL. Do you go by the SOL in the state you live in or where the OC or the CA live in? I live in South Carolina where the SOL is only 3 years, but I moved from a state where it was much longer.

    The OC can chose to sue you in the state you incurred the debt or the one you live in now.

    I don't believe they can sue you where they are. If I'm wrong, someone will correct me, I'm sure.

    Thanks for the reply. But what state's SOL do you go by?

    The pertinent SOL is the one in the state in which you are being sued.

    SweetnSas is correct, the creditor can sue you in either state. Proper service must exist. Then you can petition the court for a change of venue.
