Has anyone ever heard of this CA? They have taken to calling my house four times PER MINUTE, (completely serious, have phone records). I usually get between 10-15 calls per day. They are calling a private number that I only give out to family and friends. Obviously, I am not answering...there are no messages, etc. Most of the time, I am not home when they call, or I am sleeping (they sometimes start around 8AM) I only figured out who was calling when I called the number back. I don't know what they are calling in reference to, either! Should I call them and try to figure out what is going on? Suggestions welcome!
If they are calling the wrong party, it is in your interest to call to get them to stop. If that turns out to be the case, follow up with a letter summarizing the extent of their calls, and including a demand that they stop calling, sent certified. If they are calling 4 times a minute, they are either trying to harass whoever they think they are calling, or they don't know how to set up their equipment. Even if they are trying to call some other party, you could probably sue under FDCPA, since they are engaged in collecting a debt. If they are attempting to collect from you erroneously, it is in your interest to call to create a first contact, and request validation in writing. Otherwise, any damaging information they may have placed on your credit reports will continue to damage you, whether you know it is there or not, with no liability to them. If this is the case, you can pile on their harassing calls on top of any other FDCPA violations you may encounter in getting them off your reports. Do not provide them your SSN or DOB. If they do not already have it, they have no legitimate reason to get it from you. If they "cannot locate your file" with your name or the phone number they are calling, or cannot stop calling your number, they are not maintaining systems to prevent the harassment you are experiencing. Proceed with a written demand that they stop making harassing calls to your number, since they have stated they are not collecting from you, and file a complaint with FTC and your state AG. Four calls a minute, or 15 calls a day, is harassing whether they intended to make them or not, and whether you pick up or not. You want to create the paper trail of your certified letter to them, combined with the written complaints to FTC and state AG, should they fail to stop, or should they actually be trying to collect from you.

In any case, you may have a cause of action against them...but, as ontrack said, you DO need that paper trail. Since the account is not yours, you should simply tell them to cease and desist (shut up entirely). Once they drop the account, any TLs should also go away--they have to. That is, if there are any: CAs tend to not place TLs on reports, not even CA law firms. At least, in my experience, this has been the case. If you want to be sure, get the "hard copy" reports directly from the CRAs while you are at it; if they are reporting, then you may have FCRA violations, too.
