Sorry Side of Sears

    Appropos of nothing, while digging for some dirt on Macy's/ Federated Dept. Stores, I ran a cross an interesting article on Sears. They've been seriously bad boys. Thought some of you might find this interesting.

    The only dirt I've found on Federated is that they were fined 1 mil, I think, for collecting discharged debts after bk. It was the state of Tennessee who sued them and won. I don't think it was in federal court though.

    I found it through doing a search in google. I think I used burdines as a search and facs or facs group. You may want to try federated department stores.

    What is your problem with them? I have an old chargeoff that verify every time. And they have sent me old account statements. But, they do not have the original application on file.

    I really don't want to waste my time suing them but it is the only chargeoff I have left on my cr. I got it off Equifax but not Exp or TU.

    I hate to hold back, but I've found a couple of things that may be helpful in the near future. I'm drafting a letter right now. I'm reluctant to post the specifics beforehand (prying eyes and all that). If it proves successful, I'm sure I'll be crowing about it, though I still doubt that posting the specifics would be wise. When and if the time comes, if asked by a CN member that I recognize (such as betacredit), I'll e-mail you a copy of the details.

    In 1992, my husband and I filed for Bankruptcy, Sears was a creditor included. They contacted us about reaffirmation, we agreed. I found out about the lawsuit about four months ago.
    I have sent letters to several Sears Executives asking for proof our reaffirmation was legal. No one will respond to my letters. Today I'm going to send a fax to their legal department.

    Between my two sears accounts, they were my "biggest" creditor during b/k. This was during the time they were being sued for their reaffirmation agreements. They never contacted me once. I even tried to call them because I wanted to keep the items I had purchased. Nobody would return my call. That was almost 6 years ago, I've still never heard from them.
    I also had a Robinsons-May account which I re-affirmed. I paid it off. Some time later I received a letter saying they had been sued and I would be getting a refund of everything I had paid on the "re-affirmed account + interest. Sure enough, several months later I got a nice size check from Robinsons.
    So......keep on top of Sears!!!!

    Thanks for your reply. I just faxed a letter to Sears legal department.
    I have sent a total of 5 letters. I received one today from a assistant paralegal at Sears, she asked for 30 more days to investigate!
    Excuse me but I have been waiting 5 months already! I gave them until next Wed. to respond by fax with a copy of the reaffirmation agreement and proof it was legally reaffirmed.
    We'll see.
