    I've long been saying that a Collection Agency that uses an auto-dialer is playing Russian Roulette.

    Thanks to the Seventh Circuit, there are a lot more bullets in the chambers...

    The brilliant legal minds at Enhanced Recovery Services, were trying to argue that "Express Consent" allegedly given to the alleged original creditor to contact the consumer "intended party" via their phone, which could potentially be a cell phone, gave them a right to call the "called party" at a cell phone number.

    Soppet and Tang were receiving collection calls for consumers of AT&T, whose numbers were later recycled to Soppet and Tang.

    The ruling included a really nice barb at the idiocy of Enhanced Recovery's argument, and ACA's amicus brief.

    Within days ago, ACA was just be-moaning it to their membership a few days ago. :) If you google the case you can see the non-satirized version of it. :) Although, I was pleasantly surprised that the court itself satirized the CA and ACA in that nice little jab which I made sure to underline and bold... :)
