Spoke too soon

    I was so happy last week that my results for Experian cam back that the CA deleted their account after I sent a second validation and disputed it.

    Saturday I got a letter from a new CA with new fees tacked on(not sure what for). Anyway do I start over with new round of validation? How long can they sell this account?

    The statute of limitations will be up in a few months if we go by WA. My husband paid the account off in May 2001. Open accounts are 3 years in WA. But here's my question. The tools were purchased in Oregon and all payments were made in Oregon. My husband paid the guy when he was at work. We live in WA though. Oregon is 6 years. That would be sad.

    The Validation Letter Response had BETTER include the contractual explanation of these new fees, otherwise the CA has committed a FDCPA violation and I wouldn't hesitate to sue them for it.

    The SOL is based on where you LIVE AT THE TIME.

    You state that "My huband paid the account off in May 2001." Why is a CA hounding you for a paid account?

    Thanks, that is the letter I am going to send. I think I will wait. I like to extend things as long as I can so I will wait so they receive it a few days before the 30 day time frame is up for me to dispute.

    I was thinking of asking them about the extra charge. This started out at about $80 or so a year ago and is now $106 with the new CA.

    My husband paid the account off but there were no good records of anything. The salesman decided to mail a bill for the $80. Husband was laid off at the time and was pretty sure he had paid it off and when we calculated the charge and our payments and it was. By then a CA had it so we sent validation letter. There is no way they can validate. There was never a signed contract. The only thing they have is a receipt saying my husband bought a tool and a printout from Quickbooks that is dated after the account went to the first CA. It doesn't even say on the receipt there is a balance owed.
