I have a friend whose wife is a credit mess and continues to make bad decisions which he is left to fix. I already told him he either needs to lock her up or divorce her... but their marital issues belong on some other board. I am trying to help him clean up his credit. He requested and recieved validation papers on a collection account. BUT, it is clearly not his signature and his signature totally matches his wifes on this application. It is clear that she applied for joint credit to purchase this item which was never paid for. We are in California. Can he dispute it because he didn't sign it, she did in his name, or because it is California it won't matter? This is an amount of $2500, signed contract, signed in 1998. So at 5 years, I am under the belief that it is past SOL anyway. He is also concerned that she can get nailed for fraud but I would think since she already has responsibility for the debt, that is the limit of her liability. I have some other questions about this debt but I will ask that first, because the rest may not matter. Thanks!
What is "family fraud"? I think he may want to gather the info on this and scare his wife with it into thinking she could be prosecuted if she continues to apply for things in his name. We tried to search some legal stuff online and couldn't find anything.
