Anyone know how to find information about FDCPA for commercial debts? I read that in my state (Ark), state law extends the provisions of FDCPA to include commercial debts. I'm considering sueing a collection agency for continuing to harrass me for a commercial debt I don't owe and have disputed in writing, but I need the case law to back me up. Their "lawyer's office" says they don't have to provide validation of the debt. And they hung up on me when I laughed and told them that it's my right to demand that they prove I owe the debt. Any ideas? The original creditor actually owes ME money, and they've even admitted that, and they've supposedly told the collection agency to close the account. But I got yet another letter today threatening suit if I don't pay (I assume the lawyer now has a personal vendetta since we got into a bit of a shouting match). They also say that they don't send letters out to confirm that the debt isn't owed. Anyone?
