Here's the question: I've been reading about information pertaining to SOL in various states, bonding requirements, etc. This may seem like an elementary question, but here it is...... Do the license and bonding requirements apply for the state you incurred the debt in, or the state where you now reside? I live in GA, 99% of my debt is from FL, do CA have to abide by FL laws? OR GA laws, because that's where I reside? Thanks, and Happy New Year
The two states I would focus on (if there are 2) is the state you reside in now and the state the CA is in primarily. I had this happen and they were the most helpful in expediating the process when I found them unlicensed in my new state of residence. Let me be clear..are they contacting you in your new state now? Addressed to your new residence?
Yes, I have had one send me a bill in my new state since I disputed with CRA- (you can see my thread about CA contacting me to get an idea of the situation). The bill is $400 from FL, I now live in GA. I think the CA is in FL as well. I guess what confuses me is that in GA the chart says license- NO, bond- NO, so I guess there are no "requirements" for CA to operate in GA (I could be very wrong-still learning). But if I'm getting the gyst of what you're saying then I'm thinking the CA must meet the requirements of the state THEY operate out of- Correct?????
Actually, yes, there are.. Let me clarify... I am answering based on bonding/licensing requirements...not for SOL, ok.. Alright..here's the facts on GA...http://www.lawdog.com/states/ga/st1c.htm And, if they collect more than 20 payments they do need a security bond. Even if less than 20, they must have written authorization. Since they have contacted you in GA, and are aware you reside in GA, then they should comply with GA laws and the laws of their own state unless GA has a law excluding out-of-state CA's..looking now..

I'm doing some more reading as I see conflicting info out there with the lawdog site..will update as I read or maybe someone here is sure and will post.. Here's their state website link with laws: http://www.ganet.org/rules/search.cgi which I got to by using this link www.georgia.gov and choosing Agency rules and regulations OK..here... http://www.legis.state.ga.us/cgi-bin/gl_codes_detail.pl?code=10-6-100 The official code of Georgia...the key words are county where principal business is located..so if they are not located in GA, you might want to focus on the laws in their state. Would appreciate anyone who can confirm or clarify or correct this thinking..
