Advice is appreciated. Back in 1991 I attended a college in SC. I was in a bad car wreck and had to postpone my college career for a year. I completed fall term and paid them for it. Since '92 they have been trying to collect on me for the time I did not attend. I'd receive collection agency letters every three or four years. Nothing was ever done on their end. They'd stop communicating and I'd assume they'd stop. To make a long story short, it has been 12 years this fall and I received a collection letter a couple of weeks ago...from the same agency that's been trying to collect since '92. Statute of limitations in SC is 10 years. Can they still try and collect on me after this? Can I just write a cease and desist letter to them saying that the statute of limitations has expired and to stop harassing me? What is your advice???
The only 10 year SOL in S.C. is for a filed judgment, everything else is 3 years. Was this a Federal guaranteed student loan? It is possible that if it was, it may still be collectible, as Federal student loans have NO statute of limiations. The other possibility is that this is one of the"garbage" collection agencies who plague people for debts that are WAY past their legal collection time.
No, this wasn't a Fed Loan. I have paid all of my student loans up. This is the college trying to collect on me.
