I sent an Intent to Sue letter to a CA a few weeks ago for violating FDCPA. Of course I sent it CMRR and it was delivered on 5/24 at 5am but they so conveniently didn't sign for it and pick it up until 5/28 at 3pm. I guess CAs take extended 4 day holiday weekends. How long should I be waiting for a response? In the letter I pretty much said you have 5 days to delete or I will sue you for your violations... It's still showing up but they haven't updated it with the CRAs. Should I even assume they will respond or no? I really don't want to get into actually suing them, because yes they did violate, but I just don't think logistically we can sue right now (we are stranded out in the Pacific and they are in Florida). The only thing that I really care about it getting it removed. What would the next steps be after waiting? Should I dispute with Equifax and hope they don't respond? I've already disputed with EQ once and it came back verified but it was before I sent DV (which they never responded to)
Yes, dispute it. What will happen: 1)They won't respond to dispute and it'll delete or 2)They will verify TL thus continuing collection activity and violating FDCPA

If they don't respond within a month, the next step is to go to the Federal District Court, and file the suit.
(whistles innocently) Since in addition to dropping off the updated (document 41) to my one-year old case, I filed two more while I was at it. I was nice, since it was almost closing time, and didn't file the other two that I had waiting to file...
