    Clearly they state "MATTER OF FACTLY" that the TL was "certified" by Hood County Clerk.

    NOT the Hood County Clerks Office, one of the things I was looking for.


    A lot of times, when it comes to court records, the CRA's use 3rd party examiners. Basically people whom, on a full time basis, run around to court clerks offices and "verifiy" records for the CRA's.

    Yes, this is actually a job. LOL

    I was looking to see if perhaps they'd used one of these 3rd parties, they (at least said) they did not.

    Am I correct in assuming that the "Bay" account is something altogether different?


    Since the lien has been "re-inserted" how many days do you think elapsed between the day it first re-appered on your CR, and the day they wrote this results letter?

    Secondly, even though you faxed your letter of 10/29 I think you should go ahead and pretend you didn't, and fax a demand to see a copy of this "certification".

    There's a possibilty at least that their left hand may not catch what their right hand is doing in time to catch their response, which will be similar to LKH's.

    Your letter of 10/29 explains that you spoke to the clerks office. We're hoping they will respond to your demand for this cert. BEFORE they realize you talked to them, and that you're not a push-over.

    In other words after your letter of 10/29 it's gonna be hard to "play dumb-sht consumer". Which would have been perfect. But what's done is done, no biggy.

    Thanks for your results of 10/31.

    I am in demand of a copy of this certification you allege to have received from Hood county, on xx/xx/xxxx.

    Please mail to:

    Blah Blah.

    Just that simple. Keep the words VERY limited.


    Let's try this and see what you get, ok?

    I already ask for verification and a copy of the certification, they did not provide, the letter you have is what they sent for procedural verification. Should I send yet another request for verification?
    Yes the Bay area is different and has been removed.

    From what I can see about you so far Trent, doesn't sound like you're the kinda guy who'se ready to take a lot of crap from them anyway. GOOD!


    But let's see if you can let em "play" with you just a little longer.

    They actually sent me a reinsert letter 4 or 5 days defore it showed up on PG or worth knowing so I am not really sure.

    Take lottsa notes when you speak to the Judge.

    Go ahead and fax it first, preferably to a higher department. You're hoping to "outrun" your 12/29 letter.

    That is exactly what I was thinking sassy. The judge wanted to meet with the potential plaintiff to determine if in fact the court had jurisdiction in the matter. Why waste everyone's time filing a case that the court has no authority over to decide.

    In a small town, the judge probably has more than enough time to weed out those that shouldn't be filing in his/her court to to begin with.

    Of course I am not a lawyer.......................

    Last time I went into the JP's office here in my small TX town, after answering her other phone line for her, since the clerk was out and she was tied up, she spent 45 minutes walking thru the office showing me her John Wayne Collection.

    Did you know that Dollar spent his retirement years on a ranch not far from me?

    saw you guys did a lot of work since i last posted so i thought i would read up and i have just one question (not being confrontational here):

    are the county clerk and court clerk the same person because i see them both being referrenced? a county clerk would handle deeds, taxes, elections etc, whereas a court clerk handles the court crap. just wanted clarification.

    I never said a word about COURT clerk, I said the courthouse. It has always been the county clerk, She is the one that wrote the letter.

    I did not ever intend to stir up anyone, all I wanted to know is what to do with this great piece of documentation.

    JLYNN, I had the same thing happen with the town traffic court judge, got a ticket , found out he was an old Navy pilot, spent 3 hours talking about the Navy and ended up with a ticket dismissed, that is what makes Texas politics so fun, its all about making friends and shooting the sh*t. amazing what can get by all the rules if you try

    i believe other people referenced court clerk - whatever. IS there a court clerk or is the county clerk the one that handles the court issues? the reason i am asking is if the CRA faked attempt to the wrong person.

    no need to get snippy just trying to clarify.

    as you said the county clerk handles all the paperwork etc. there is a clerk of the court but he is the judicial person, different title, different area of the county, different address all together. I believe his title is clerk of the 355th judicial court so no way for them to be confused and he would send any mail/calls to the right people. There is not much room for mistakes.
    I think they just said they had verified to shut me up, they refuse to provide any tipe of certification to me at all, only a list of names.etc. I did what Butch suggested ofter I sent him the letters and faxed a demand for certification off this morning and followed up with a phone call to both TU and EFX, all I got at EFX was a voice mail, TU confirmed they had the letter and I would get a response within 30 days. I explained this was not a request for an investigation .

    Factoid in TX

    County Clerk - handles deeds, probates, all the paperwork for the County Courts, (which are lower courts than District Courts)

    District Clerk - That is what the person in charge of the District Courts (such as the 355th) is titled. They handle divorces, child support matters, most family law issues, and some criminal.

    These are both elected officials.

    Then there are individual clerks for each of the courts. Without offending anyone, you should think of them as secretarial type figures for the judges of the respective courts. At least to get it straight in your mind.

    The clerk you spoke to in the JP's office is a hired employee. JP's are located throughout counties. The population of the county drives the number of JPs. They are scattered, as this is truly "the people's court" and are located conveniently to as many people as possible. You will generally find District and County Clerks in the courthouse, or at least in the town that is considered the County Seat.

    Thank you , hope that clears up some of the misinterpretation. You are right about the lady in the clerks office Titleis deputy clerk, however she had the elected clerk initial when the letters were filed to make them oficcial I would guess. They are now part of the record with page and volume recorded.

    Get an attorney

    I believe that you should contact an attorney - ( probably talk to a couple ) - as they may very well be willing to take this matter on a contigency basis. It would be better if you had the financial resources to pay for an attorney up front. This looks like a slam-dunk case for a substantial amount of money.

    I sent all the documents to a consumer protection attorney today, the firm takes cases on a contingency basis. I will keep you informed as to how it goes.

    funny you should say that, he said the same thing, and I do believe he was salivating while reading the letters.
