I am still trying to get MBNA to send me information on the account was opened in my husband's SS# and sent to an out of state address. They called 3 weeks ago and I told them that we need information on the account. They said they would send an affidavit but They must have sent it to who ever got the card. What kind of letter will get their attention? It is on all three CR. and I have sent them letters that this is not his debt. and to delete. The last time they called they said they were going to charge the account off the 28th and we sure don't want that on the credit report. Our credit report only had to late payments in 1996. Everything else was good reports. How do noy find out your score? I sure need some help on this. I had no idea what a problem this would be. I thought when we told them it was not his they would find who it belongs to but I don't intend to pay over 16,000+ for their mistake. I can't understand why they would send to an address that was not on a CR.
Sue, First of all, place a fraud alert on your credit file. Next, go to the police dept. and file a fraud complaint. Get a copy of the complaint and then send and a very sternly worded letter to MBNA saying you have taken all of the steps possible to protect yourself and now, it's up to them. The police report is important. filing a false policereport is a felony. If you end up either getting sued or, having to sue MBNA, the case is over when the police officer who takes the report testifies that, "we investigated to the best of our ability and have no reason to suspect Mr.xxx of fraud".
