Student Loan issues

    good luck dwh. They are a b*tch to dispute. I don't know if it's good or bad that ours are paid off already. No leverage anymore!!

    All disbursements are actually seperate loans and that is why they show up on your credit report that way

    I just sent an email to sallie maes customer service. I think I'll bang out a couple of goodwill letters, and send them out to various departments or locations, hoping to hit the right person.

    This is from Title 20 of the US Code:


    (iii) no administrative or other fee may be charged in
    connection with the granting of a forbearance under clause
    (i), and no adverse information regarding a borrower may be
    reported to a credit bureau organization solely because of
    the granting of such forbearance;

    Where it says "Laws: Cases & Codes", click on
    US Code, then fill in the boxes: Title 20
    Section 1078

    Section 1078 will come up on the screen; scroll down to (3) Forebearance, and read (iii) under that.

    Experts, let us know what this means. Also, I've read the entire Title 20 a couple of times, and I think it could be a veritible gold mine, if we could just decipher it. This is the actual law that the guaranty agencies and lenders are bound by law to adhere to.

    That section only deals with forbearance and is states that no fees or adverse info can be reported for going into forbearnce, however, it has nothing to do with late payments. Late payments, as so many here can attest to, are regularly reported to all 3 CRAs.

    Usually, when you get a forbearance on a student loan, it's applied retroactively because they are almost always given after the fact (after the lates). The forbearance essentially serves to wipe out the lates, bringing the loan current. So wouldn't this apply to lates?

    yes, the forbearance wipes out the lates on the account, but apparently doesn't wipe out the lates on the CR. Where it says "and no adverse information regarding a borrower may be

    Unfortunately I think it means that they can't report negative things BECAUSE of the forebearance, BUT because you were late in the first place, they CAN report that. What I still don't understand, and I know I sound like a broken record, is why the forebearance makes your account up to date, not late--then why do they STILL have to report it to the CRA's as late? Makes no sense to me. Maybe I'm just dense (ok, that's probably the reason!! LOL)
