Stupid Small claims question......

    I filed against a CA in January, they have until tomorrow to file a response. I called the courthouse yesterday to ask if we would receive a copy of their response, if they filed one, they said NO.
    So hubby calls today to ask a different question about if we settled and got on the phone with a supervisor who answered his question, so he asked again would we receive a copy of the response, she said YES.

    So for those of you who have filed a small claims suit, did you receive a copy of the response??

    I ask becasue we faxed a settlement offer yesterday for $1000 plus deletion, but should we wait it out and hope for default for $5K?

    They file the original with the court and have to send you a copy. But, if you do not get one when due, check with the clerk of the court. Many times they will not send you a copy.

    They usually will not file until the last day. And, many jurisdictions give them an extra five days to file if they were served by mail.
