success against cap 1

    just want to share some good news to give you all hope and let you know once in awhile you win one.

    most people here know cap 1 will not delete or back down.

    my pursuit paid off with the federal reserve complaint and a letter from our attorney.

    cap 1 is being forced to remove the TL from all 3 of my reports.

    the FR produced a letter stating their violations, while waiting for the FR to conclude this matter we obtained an attorney who informed cap 1 of the same thing and informed them to delete or suit will follow.

    we can expect full deletion for the acct in 30 days.

    we still may pursue legal action as well.

    like I said before file a complaint with the richmond Fed Reserve it may help you.

    What sorts of violations did you have them on?

    FCRA 1681 , FDCPA 1692 and various sections of these codes and others

    failure to remove inaccurate data
    failure to flag acct under dispute.
    failure to provide verification of a debt
    misrepresentation amount of debt
    unfair business practices

    continued collection activity past sol
    re-aging the debt
    .
    verifying a debt with the cRA as acurate when no proof has been supplied to substanciate the debt

    now we will pursue the CRA for failure to delete inaccurate, unverifable info after written demand on 3 occassions.

    failure to disclose method of investigation

    failing to obtain verifcation from the furnisher that shows the debt is accurate.

    rejecting my proof that this debt was invalid and failure to forward that info to the furnisher during an investigation.

    so who do I go after for tu putting currently 120 days late on an account that has been settled as of 10/00 and has a dola of 1/98. Since eq has status n/a and ex has it deleted, it looks as though tu is doing it, but they say its verified

    dispute the inaccurate reporting with TU and state your reasons and give them any proof you may have and request either deletion or update.

    Oh wow that's great news for you! I'm definitely going to write to the richmond address you gave as well as cap1 in regards to my acct.

    no settlement no payoff
    just a full dispute and they had no proof to back up their claims .

    My attorney sent them a letter stating that they can not pursue me for a debt they have no proof of and told them they must delete the acct,

    next is the lawsuit for all their violations I posted these violation above .
