As of today, my credit report is certified 100% Collection Account Free (TM)!!! That is, 73 (!) phone calls, 14 letters, 12 credit agency disputes, a few conversations with the State Attorney Generals office, a wing and a prayer later... Now I've just got 3 paid charge offs to deal with. Ugh. Any ideas where to start? I searched through the archives on this, but most of what I found involved disputing with the CRA's and crossing your fingers. All the charge offs are around 4 years old, and all of them verify every time. I've tried disputing with fingers crossed and without, but it seems to make no difference. They are Discover, Mobil and Dillards. Anyone had any luck with them? (Discover is even a Paid in Full for less than full balance. Ugh.) Heck, Mobil Credit isn't even in business any longer and they still verify the account. Is there any hope for these accounts? Should I just keep disputing and hope I get lucky? Does crossing your fingers at a certain time help--say, when I seal the envelope, or when I drop it in the slot? -- cnswift TU: 534 - EXP: 624 - EFX: 577
Try this letter for the paid settlement accounts. http://consumers.creditnet.com/stra...5081#post125081 Have you tried sending validation letters and disputing with the CRA's at the same time? If the CA or orginal creditor verifies before validating the account it's a clear violation of the FDCPA. Verifying a debt is considered a collection attempt and can't be done before validation is complete. Then you can use these procedures: Continue validation with estoppel letter after 30 days from CA's receipt of validation letter, wait 30 days from the date of receipt of the estoppel letter and then send the CRA copies of the letters and green CRRR cards. This shows that the CA or original creditor can't validate the account. The FCRA Section 611 states that CRA's must accept proof of inaccurate reporting from the consumer. You can cut and paste this info. and/or
continued If the CA or orginal creditor verified info to the CRA's before validating the the debt you can send this letter to the CA or orginal creditor. KHM wrote this one and it's really good. http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&postid=128166#post128166 Customize it to your particular situation. Also, read this thread. It is very informative. http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&postid=132755#post132755 I hope this helps. Bobbi
