Sue for Soft Inquiries?

    A few more opinions never hurts. With a dozen potential lawsuits on the line, I'd like as much ammo as I can get.

    Well ... sure, see your point.


    With No PP cases the law is wonderfully clear. In these cases it's not one of those silly $100 - $1,000 fines, and maybe you'll win and maybe you won't.

    It's a FLAT $1,000, no if's and's or but's. I got mine to prove it!

    That's what "statutory" fine means.

    If they pulled your report without your permission go after your money. It's truly that simple. Not a lot of room or need for a lot of opinions. That's why I was wonderin if you were unclear on something.

    There's a BUNCH of us on here that have been paid.

    I have been reading the posts on the board for several weeks now, as well as the topics at the top of the thread. I am, of course trying to repair my credit. I guess I was stupid, I did not realize I could even attempt to my repair my credit. I have learned so much in the last few weeks from the knowledgeable members of this forum and I feel so much better already. I have received my Equifax report and have 9 soft inquiries on there from Citgo/Citibank SD. I have not had a credit card with them since 10/96. My balance is showing as 0, a charge off. I have not applied for a another credit card with them. Do they still have the right to keep pulling softs? It seems like they are doing this every other month. Thanks!

    I will take ANY and ALL of your PRM'S or AR'S...as long as they are FREE!!!

    PRM'S and AR'S only HELP!!!

    But since I am ALWAYS WRONG...it does not matter what I think!!!

    Oh, so these PRMS and ARS that I have are good to have on my reports? I have started out slow, and sent the letter to Equifax that contained an old address, I got the letter back today with it removed. I know that is a small thing, but it gives me a bit of confidence. I am overwhelmed by the wealth of knowledge on this board, and I found it on my Gardening Forum. :)

    Welcome to the board.

    Citibank - You mentioned it was a -0- balance chargeoff. Did you pay it after it charged off, or is the balance reporting incorrectly?

    After reading this thread, I think I am confused. I was looking for info on AR's. Specifically who pulls them. It was my understanding that is was an account review. Which would mean that you had an account with that company at some time, right? Well then how did Texaco/Citibank Sd pull 8 AR's when I have never had an account?

    Some guidance would greatly be appreciated!

    Hi Michelle,

    You're presumption is exactly right.

    An Account Review is for just what the name implies, to review your account. If an acct. doesn't exist, it's illegal.

    Each AR may be worth $1,000.

    So does this mean that anyone that you have ever had account with can conduct an Annual Review? I owe Citgo no money, but they can continue to review my credit report every other month without my permission?

    The FTC has an advisry opinion letter that deals with this area. their opinion (which incidentally should be upheld by any hudge with at least 1 Law course under his/her belt) is that when the account is paid off and closed the permissible purpose is gone. I am suing 2 creditors for just this violation.

    You owe no money, but is the account still open? If its still open, and you could go out today and buy gas and a soda, then they have PP.

    In Butch's case there never was an account. In my case the balance was zero and the account closed several years prior. In both our cases we have grounds for a FCRA suit for non-Permissible Purpose. If the account is open and available for charge then the creditor still has Permissible Purpose.

    The account is no longer open. No, I can not go buy gas on that card and I have not applied for another credit card with Citgo.
