Sue under FDCPA and FCRA?

    Sent a modified validation letter to an OC. They responded with a letter with a completely different account number. They did not report the item as disputed on my credit report.
    Sent a second letter telling them about the wrong account number and requesting a deletion of of this from my credit report or I will be taking them to court. I'm sure they will not report this account as being in dispute again. Do I sue under just the FCRA or the FCRA and FDCPA??

    You can't sue an oc for violations of the FDCPA as they are not liable under the FDCPA and are not required to respond to a validation request.

    I'm just talking about the fact that they did not list the acount on my credit report as "disputed", I know they don't have to validate.
