Sued AFTER BK? What do I do?

    Well, it's been a month after discharge and case closed. I get a summons on my door that I am being sued by one of the creditors I filed on. What should I do? Re-hire my attorney or handle this on my own? Do I have any recourse to collect for damages? Any info would be greatly appreciated.

    that happened to me i just called up my attorney that did the bankruptcy and they handled it. i never heard about again after that.

    Consult with your bk attorney if he was a good one, or talk to a consumer attorney. There are grounds for a countersuit for violating the permanent injunction granted by the bk court. Especially if the people who are suing were listed on your creditor matrix.

    You should be able to get a few grand out of them if you hire an aggressive attorney. More if you have proof of damages like having to see a doctor for anxiety or chest pains which are stress-related. Some lawyers will take these cases on contingency, so you'd only have to come up with the approximately $150 fee to file a countersuit requesting a jury trial.
