Today I was sued in magisterial court for an unpaid credit card debt. It was filled out for Capital One C/O Edwin a Abrahamsen law firm. When attempting to determine the validity of the documentation the lawyer presented to the court, the judge asked the lawyer representing Edwin A Abrahamsen if they represented Capital One.. ie. Capital one themselves were suing me.. the lawyer said yes. When I got home, I called Capital One and they claim they sold the debt and are no longer servicing it. The Judge did not render a verdict today and said we would get a letter in the mail in 5 days with the verdict. Is there any way I can tell the judge that the lawyer was "less than truthful" when asked who exactly was suing me? Also do I have any sort of legal standing for going after the lawyer and/or Edwin A Abrahamsen for stating they represented Capital One, when in fact they did not?
I'm not a lawyer, but it you have proof that he lied and he is in no way representing Cap One, then I would take that proof to the court house and request that it be included in the case file. Hopefully the Judge will review it before issuing the verdict.
