I got this from my countys municipal courts website... A small claims suit must be filed in the Small Claims Division of the Municipal Court having jurisdiction. A court has jurisdiction if the transaction or incident took place in that court's territory, or if the defendant has assets there. IC systems in minn. is trying to collect a supposed medical debt from me that occured in the ohio town in which i live.. I have them on several FDCA violations as well as FCRA violations.. now when i sue them according to the above, can i sue them here in my home town since the debt supposedly happened here???
Doesnt matter where the debt occured. Its where the violations occured. The FDCPA and the FCRA both have a statement that determines jurisdiction. Post those in your complaint. But you can sue them locally. You must make sure the CA is properly served or your case will be tossed out. Good Luch!!!!
