I'm preparing suit against a CA and have contacted my state's Sec. of State regarding the CA's registered agent. SoS replied that they do not have any entity listed under the name of the CA. Has anyone encountered this before? I'm unsure of how to provide proper sevice upon the CA in this situation.
That might mean you have to sue them in their state. I am not sure about this. Someone please advise regarding this.
You can sue in your state - but call the SOS for the state they use in their main business address. For example - the CA is in Virginia - so you'd call the Secretary of State for Virginia. Mommy2cats
This could indicate that they are using a fictitious name. If it is a d/b/a, you might be able to find this out at the clerk's office where they are located, or by doing an internet search where several of their names might appear. Sometimes the d/b/a's will show up when you do a search at bbb.org. L
