Suing DirectLoans Legal?

    I've heard that there are limitations to suing the government. That stated, is it legal to file in Small Claims against the Ed. Dept. DirectLoans?

    You can't sue the Federal Government in Small Claims court. Since the Dept of Educ is a federal govt agency, I am pretty sure you would have to sue them in a Federal Court.

    You might want to do a google search.

    What is going on with your Direct Loans?

    What are you suing direct loans for? I just consolidated with them, and would like to know what business practices I should watch out for.

    I've disputed with them several times, by phone and by fax. But they've never reported the dispute to the CRAs-- a violation of the fcra.

    What are you disputing? Do you have more background on your case?

    You might try sending your disputes Certified Mail RR. This way you will have a a paper trail. They can say they never received the phone call or the fax.

    Student loans are a tricky subject. I would love to see some statistics on how many SL are actually reported correctly.

    I have a Sl nightmare right now. My loans are current and in consolidation, however Sallie Mae and my State guarantee agency are reporting them in triplicate in their defaut status! It has been over a year since they have been current and I have been working on correcting them for 8 months. I borrowed every qtr I was in school. You can imagine my CR. It reads like a novel!

    Give us some more info on your case & we can probably be ofmore help.

    Disputing late pays they placed on my report while it was in deferment. They admitted it was their mistake, but have never made the corrections to the 3 CRAs. I'm fed up and at this point I'd like to collect $3,000 for 3 violations of the fcra (not reporting in dispute).
