I was at the court house and just happeded to see my name in this months common pleas. This is Citi bank accounts that a out of state Attorney licenced in SC has going after a Judgement. I have not been served by the Sheriff yet. I have heard that one can be served by publication! This is when it is posted in a local newspaper. I have about 2.5 weeks left to respond to the attorney to reqest validation from them because it states I have 30 days from the date of service.. Should I wait for the sheriff? Should I call the Sheriff to see if I am on the list? If it is posted in some newpaper I have not seen it, What should I do??.
If you have a judgment against you, then more than likely the plaintiff attempted to serve you but could not. If you never answered the complaint, they can get a default judgment entered. Serving it on you usually comes toward the end of the game. Unless the debt is actually not yours, there's probably not much you can do about the judgment. It's gonna be there, no matter where you are.
OK. I went back and re-reread your post. So, while you happened to be at the courthouse you noticed your name in the "Common Pleas". Not all states have courts of common pleas. In any event, we'll have to assume that you saw your name on some kind civil docket or another, but to your knowledge you haven't been sued. If the OC or the owner of the debt has filed a complaint, they'll be looking to have you served by a Sheriff, a private process server or (if you prove to be too hard to catch) by publication. One way or the other, if they make reasonable but unsuccessful efforts to serve you personally, they will do it by publication. But it sounds like you already know all this. I'd at least answer the complaint after you've been served. But if the debt's yours, they can prove the amount, then there's little magic to perform at that point. Try to work out a payment plan. They may want to do a deferred judgment (not filed and entered if you pay it all off). That's usually OK.
I'm kinda in the same boat.... The attorneys that are trying to sue me for a expired SOL debt, sent me a notice saying that they were going to court to motion for a special process server. i called the courthouse and the motion was granted. that was 3 weeks ago!!! shouldnt i have rec. the summons by now. no one has came to my home nor my job. what should i do call the attorneys and ask "where's my summons" (just kidding) or what? can they not serve me on purpose just so they can get a default judgement?
