A summons from Chase was issued against me. Although I never received it, itâ??s still effective according to NY law if as they claim, they delivered to my residence. Regardless, it turns out that a while back I made a payment via bank transfer on the internet. I always paid them this way and it always worked. For some reason, the bank did not honor it this time. Not because of NSF etc. The bank told me later that the amount was to big to be transferred in this manner. (Supposedly, since it is a savings account, I cannot transfer ANY amount this way.) This happened a while ago and Chase never bothered notifying me about this payment that didn't go through. They do admit that they see a payment was made but not honored by the bank. To make a long story short, they now have a summons against me for close to $5000 and it is in litigation. They did not process a Judgment yet, but I am past the time which I have the opportunity to answer the summons. They are ready to settle for 65% they call it ("settle in full"). But I have a bigger problem with the negatives info on my CR then with paying the debt (even in full minus the extra fees etc.) Chase, as usual is not going to do anything about that. They'd rather get less money from me by settling then get the full amount and remove the derogs from my CR. My questions are as follows: 1) If I'm past the days that I have in order to answer the summons, and they didn't get a judgment yet, can I still answer? 2) What are my chances in court? As said, I'm ready to pay, but need the derogs off my CR. My claim basically is that they never bothered notifying me that my payment wasn't honored by the bank. Is there a chance that the courts will make me pay and have them remove the derogs? Thanks in advance!
