Tac14033...can You Help Me?

    TAC14033,

    I am needing your help. I read your post concerning Marlin Integrated Capita...it's war, and I would like to know what was your "terms" once you knew that NCO owned Marlin? You stated that they agreed to them. Do you have a number for their attorney? My thing is, I don't want to go the legal route w/ them, I would rather them know that I know that their are in violation and have them delete these account from my report. I am willing to settle w/ them for $172. ( the bal. was 394. I sent $50 to the CA before I found out about this violation).

    Can you suggest a route? Thanks for all your help.

    No problem,

    Since I didn't sign any confidentiality agreement with them I can disclose this info.

    I first found out NCO was owned by Marlin by contacting Marlin's toll free number and pretending to be an attorney I asked them who in their company and where to send legal correspondence to. They gave me an address in Horsham, PA and the name NCO. I asked the lady if Marlin is in fact NCO and she said yes.

    I had tried to validate a debt with Marlin for more then 3 months. The ignored all of my correspondence and verified it with the 3 credit bureaus more then once.

    For me it was time to play harball with them.

    I then filed my suit under NCO Financial Systems aka Marlin Integrated Capital and the court sent it to them certified and registered mail.

    The day they received the suit I was contacted by their attorney who is from the lawfirm:

    She contacted me and was very nice, respectfull and polite. I felt bad at first for kinda being or sounding mean since I was so mad at NCO, I kinda unloaded on her and I apologized.

    She asked me what was my complaint and I went over my complaint with her and NCO/Marlin's Violations.

    She asked me what they needed to do to settle this out of court and I stated it would be for full deletion and $1500.00. She said she didn't think that would be a problem and who do they write the check out to?

    I told her who to write it out to and she stated it would take about 5-7days for their office to receive the check from NCO, in the meantime she would look into the account and contact them for the deletion.

    I had my attorney draw up a general conditional release from liability and faxed it to her with all the legal jargon and specifics of what they had to do.

    She called me back in about a week and confirmed with NCO that it was now in fact deleted from all of my credit files.

    She Fedexed me the check and signed contract overnight and I had it the next morning.

    I signed it and contacted the court to dismiss the lawsuit and faxed them confirmation of such.

    It could not have gone any easier and I wish everyone I've ever sued had the professionalism and repect to consumers as NCO's attorney had.

    Please use this info and put it to good use, I only ask that you not discuss where you received this info from or this recent case with them.

    Just tell them you contacted NCO and they refered you to her.
