Will try to keep this short....several years ago my husband got behind in his student loans. While he was off on workmans comp. the company closed. Anyway ISAC turned it over to Wexler & Wexler for collection. They obtained a judgement. Made payment every month and they also took our tax refunds. Well this year our refund was for $1200 more than is owed on the loan. But the Dept. of Treasury sent ISAC the full amount of the refund. I called ISAC they have not returned my calls. I called Wexler and they said it can take them up to 6 months to receive word from ISAC that they received the refund and that the account is paid off. I emailed the Dept. of Ed's ombudsmen office and have yet to hear from them. Is there any suggestions as to how I can get my $1200 back that they now owe me. Also I do not want to wait 6 months for his credit report to update showing this judgment is paid. Any help would be greatly appreciated! Thank YOu!
SEND A BILL---"THIS IS A COLLECTION NOTICE" or what ever words they say... Payable in FULL in 30 days.
lol...since this is an extension of credit, do you have a PP to pull Wexler and Wexler's credit report? Hehehehe
Finally heard from the ombudsmen office today. They checked into it and called me back this afternoon. Wexler had the correct amount on the pay off and agreed that the student loan judgment is paid in full. We will be receiving a letter from them and the Department of Education saying so. ISAC still showed us owing $3023. They told me that ISAC has the worst bookeeping system possible and that they geta lot of calls from people having problems with them. They can do nothing until they receive notice from the IRS and that can take up to three weeks. Then they will have to cut us a check which can take up to another three weeks So we might get the money they owe us around the middle of April. I don't know if Wexler wasn't updating ISAC or ISAC just isn't updating at all because they had no idea that we were making payments to Wexler every month or that the IRS had also sent them our tax credit check last summer. That is why they were showing the $3023 balance and not the correct $1200. If they had updated their records like they should then the IRS would have only sent them the $1200 and I would have the rest of my refund right now. Is there any way I can use this mess to my advantage and possibly get this loan removed from my credit records?

Re: Re: tax refund hijacked! Do I write the good will letter to Wexler or ISAC? Perhaps since ISAC record keeping is so bad I could just dispute it? If they didn't have records of almost $2000 in payments maybe they wouldn't be able to verify it on time?
Most of the refund is from the earned income credit. Obviously we don't have the best paying jobs. Between that and our four children we were eligible for it. We just really need to get our credit fixed so we can refinance the house. We are paying 9 3/4% now and would like to refinance by this summer. Other than this judgment the rest is pretty good. We have never been late with our mortgage. So do I dispute it? Or should I write the good will letter to ISAC or Wexler? From what I have been hearing about ISAC they are not the easiest people to work with.
Ewwww...my two LEAST favorite collectors: ISAC and Wexler and Wexler ISAC has no heart- there will be no goodwill with them. All they want is $$$...What's funny is all the doctors and lawyers in the state with defaulted loans do not get garnished, sued and their refunds hijacked. I had roughly 4k in student loans with them and they made my life a living hell until I rehabbed them. Wexler and Wexler is as unscrupulous as they come. What can you do at this point? Chances of you seeing that $1200 anytime in the near future is slim to none...I would just keep calling ISAC and Wex EVERY SINGLE DAY until they finally relented and give you back your money. I'm actually surprised they turned it over to Wexler...they don't need a judgment to garnish your wages or seize your assets. They garnished my wages for 13 months...would not remove the order UNTIL I had finished my rehab. The kicker was they were getting $300 a month from my job but I had to send in an add'l $50 a month for the rehab. Just try to happy that at least they're paid off...now try disputing the poison they've left on your credit file away.
