I can't find the last thread so I'm reposting. Sorry if duplicate. I filed chapter 7 in October of 07. I was not planning on getting a tax return this year, but got back about 1500 total. My discharge papers arrived back in Jan. Am I at threat of loosing these? My lawyer told me that I needed to send copies of them to him so he could quote, deal with them... Is this a normal practice? Please email reply to mnwildfan2k@gmail.com as I have very limited access to internet and will receive these on my blackberry. Thank you in advance!!

I wouldn't see how these are subject to anything if the petition has already been filed. Then again, I'm not a BK expert.

Since your right to receive a tax refund accrues as the tax year passes, itâ??s an asset of your estate. Unless itâ??s covered by an exemption, therefore, your trustee is entitled to it.

Let your lawyer take care of it.
