    These validations seem to have made things worse. Since I sent them I did get Capital One to agree with me on a payment. Haven't heard from the other CapitalOne collection agency, but have been getting an automated call that says its the office of someone - sounds like an attorney.

    The number is 7166397432

    Spoke with NCO with my CCCS counselor he's confused as to what's going but put a hold on the account so that they won't call me.

    I'm just wondering why after validation Nationwide sold these accounts. Is that pretty normal?

    If it is an attorneys office calling me - I'm frightened. I don't have money for legal representation. I just feel like I'm going to get screwed when in fact I haven't refused to pay and I'm trying.

    What do i do now?

    Tracey Wild is the Compliance Officer, I sent a validation letter a year ago on an account she sent me a letter a week and a half later that the account was going to be deleted from all 3 CRA'S

    Nationwide probably sold the accounts because they couldn't validate. This could keep going on. But it's working to your advantage. Stop the payments from your debt payment program to Nationwide and don't add any subsequent CAs on until they validate properly.

    If you're lucky, they'll keep passing it around, and no one will validate. That gives you a little more money to either use on the other bills or sock away for when you're ready to make settlements.

    Don't get upset about the account being sold, use it to your advantage.

    And maybe every one will contact your ex-husband and talk to him, maybe commit some violations and you'll eventually get all of your bills paid by someone else!! jlynn, do you think the fact that it's a business account changes the rules on who they can talk to? If he was involved in the business, maybe they haven't violated--YET.

    Don't worry about the lawyer, either. You can get representation if you can't afford it, there are some programs for that. Many will give you a free consultation, that may be all you need.

    Most people here sue the creditor in small claims court. You can do the paperwork yourself, and in some places the people at the courthouse will even help you. But don't stress yourself out until you need to. You're a long way from paying for lawyers, I think.

    The payments are being sent directly to Amex. Do I now send a validation letter to NCO?

    Do I call back this attorny's office?

    My husband wasn't involved in the business - he was only an authorized user to the card.

    Do I need to start contacting an attorney.

    Can someone please just tell me the chronological steps I need to take - I'll do them I just need to know what they are.

    If Amex is accepting the payments, your debt mgmt program should ask them to pull the account back from the CA. If it's in collections, the original creditor shouldn't also be receiving payments. Perhaps your counselor should call NCO--or better yet, have him call Amex and ask why they are accepting payments if they've sold the account or placed it for collection.

    I guess because your ex-husband was an authorized user, they would assume he was an "employee" or somehow connected with the company. I'm not sure on that one.

    They have, they won't. They either have to post or forward them, but since they won't talk to us I dont know what they are doing.

    We called him today - he put the account in a hold to see if Amex forwards the payments.

    I have the NCO info and will send validation to them, but am wondering if I should wait till they start harassing me again since they have put the account into hold. I don't have the address for the other all they left me was an automated message saying to call the office of Jim Prawl.

    Since they left you an automated message, they can't prove you got it, can they?

    Hopefully if you don't call back they'll send a letter. Unless, of course, they don't really know where you are. Which means if you don't contact them they wouldn't have an address to serve any papers!

    Above all, don't get too stressed by this. I know how it can be, and looking back on it I realize how much time I spent worrying that I could have spent doing something constructive. People here will help you along, so spend your time on more constructive things than worrying.

    I don't know about the validation letter right now. I would probably hold off, but there are others here who know more about this than I do, so if someone else jumps in, that's fine.

    I wish someone really familiar with the TILA and FCBA would chime in here - I do believe there is a time limit to post payments...

    Payments must be credited on the date received. What date is that?
    Any date the Creditor says it is.
    Payments must be posted either 24 or 48 hours "forget which" after receipt.
    Keep in mind that (Credited - received) and posted are 2 different things.
    The legally enforceable date is the day the creditor got the payment regardless when they get around to posting it!
    EXAMPLE
    Creditor gets a payment on 7/12 but they don't post it untiil 7/20.
    7/12 is the legal payment date not 7/20.

    PS
    There is another it seams little know requirement that a creditor must present a bill,invoice,statement Etc. to the consumer at least 14 days before the due date.

    Call the number from a pay phone and find out for sure who it is. Don't tell them who you are.

    Thank you for clairifying that

    No haven't sent one to NCO because thought maybe I should wait till they start harassing me again. Haven't sent one to the new office that is calling me because I haven't returned their call.

    It appears that it is for the other Amex Account since I got another letter from the other CA regarding the other Capital One Account. I received this after they signed for my letter regarding validation.

    I did this but he didn't say the name just said Mr. so-so speaking, but it didn't sound like the name left on my voicemail.

    I thought I'd get the voice response system but I didn't.

    What should I do now?

    CCCS says she is sure Amex is not doing anything illegal - she said they do everything they can not to get sued. She said they could always say they forwarded the payments that we have a tracing number for - it just took 60 days, etc.

    Things have gotten quiet since the validation letters went out. Nationwide has sold my Amex accounts to NCO. They've called a couple of times. I just haven't answered. Seems that the two Amex accounts are with two separate parties - one guy at NCO was very nice and put a hold on the accounts since we told them AMEX should be forwarding payment - the other one again I haven't returned their call.

    I got the letter from Capital one saying that they would take my account to 0% as long as i continue to pay 150 per month till the account is paid in full.

    URS collection agency sent me a letter after they received the validation letter about how they've been trying to contact me, etc. Is this a violation?

    The quiet is kind of nice, even though I know it's only temporary.
