    only 500? I'm thinking at least 1,000. Or maybe even 2,000, in case they come back with a counter-offer.

    How about the day I got gas and my check was declined, and i had no way to pay for it other than my credit card, which was almost to its limit. I had no choice but to use that card, and it put me over my limit, resulting in over limit charges. Not to mention the embarrassment of having a check declined in front of people who live in my teeny little home town where everyone knows everyone. the more i think about it, the more it burns me up.

    I just know I can think of more examples of the hell I've been thru.

    You guys think an ITS letter would really work for telecheck, or would I have to actually file?

    oh, and when i do send the ITS, should i include all the laws they've broken, and FTC opinion letters that they are in fact bound by FDCPA and FCRA? or is that also 'tipping my hand'?

    * Here's what I did one time at a gas station .
    I made the guy siphon 15 gallons of gas back out of my car.

    In case anyone's following this...

    I just tried to write a check and guess what? It was DECLINED. Holy Crap. I'm going to punch something. I'm definitely suing. No settlement. Unless its 5,000. I called and talked to the high-up lady I've been dealing with, and she was totally confused. She said she personally removed all derog. info. from mine AND DHs telecheck reports. she's having an IT guy look at it and she'll get back with me. I have proof from the business that it was declined because of Telecheck. I have so had it.

    whats the legal concept for making a person as good as they were before they were damaged by the defendant? I think it was something about being 'whole' again? I know I've read it on this board before, but I cant find it.

    ok. couldnt write a check all weekend + MLK day. wrote up a simple letter telling telecheck this. also told them that i want to keep all communication in writing and that i plan on calling an attorney. told them they can expect to hear from me again after i research this matter some more and figure out what laws they've broken.

    tried to write a check today and....IT WAS ACCEPTED. Sent my letter anyway. heh.

    just want to keep you all up to speed, lol.

    Did the establishment run the check through the telecheck scanner at all?

    Even places which use telecheck (depending on their contract terms) may not have to scan a check under a certain amount. The one local c-store's contract is $25.00. They can run it through the scanner, but their contract allows them not to. Now, if the check is $25.01 and they forget to run it through, the store would be stuck with the check (or if the check didn't have the address info printed on it, etc.)

    I thought of all that ahead of time. I made sure to go to the same place that always declined my checks. (A gas station that I know uses telecheck.) I tried a check as small as $5, and one as high as $32. Both declined. Then the other day, the one that was approved was for 25 bucks.

    I had also had checks declined at walmart because of telecheck, so i went straight there the day my gas station check was approved. walmart approved a $40 check that day.
