telecheck

    ok guys - gotta problem.

    went to write a check, was scanned through telecheck and came back that i have a "bad record". i call telecheck and they gave an 800 number for the company that is reporting the bad account. i call them and after holding for 10 minutes, it turns out it is for check from 1999 for $138 for WALMART. this dumb sh*t CSR woman threatens to hang up on me for giving her attitude - at which i point i said i have two word for you "lawsuit" and "damages". so she hangs up on me. so i call WALMART and they say they have nothing on record for me. so now i am really p*ssed off.

    oddly enough - there isn't a WALMART where i live, a complete background was done when i started my job (about a year ago) and there was nothing on any of these check scanning places. not a thing on credit report.

    what do i do? do i need to fight WALMART or TELECHECK?

    it sucked and took a long time to resolve, but i can almost guarantee you that not only will they not verify within 30 days, (there's nothing to verify) they'll take their sweet time and ask you for a bunch of personal info. You can bust them pretty easily.

    turned out to be a good thing for me in the long run.

    ETA: Jenz, Play dumb! don't act like youre gonna sue right off the bat. don't say things about damages, etc. let them screw up first!

    So I am assuming I should get a copy of my Telecheck report first? When I called Telecheck, it was an automated service, so I yelled at the lady from walmart collections. Oops - my bad! but I was p*ssed at the time. i did play dumb when I called the walmart accounting department - and she said she would get back to me on Monday. She was really helpful.

    I am not an advocate of suing - but this really ticks me off - so I just might.

    I'm in line with all sorts of stuff and i have to leave it (because i didn't have any cash or credit cards on me). I don't shop at walmart and didn't use a checking account in 1999. then to find out walmart doesn't even have me in their system. i tell ya - the harder you work to keep your credit clean, the dirtier it gets!

    youre welcom jenz...i'm loving that i'm able to help anyone here...i ask so many questions still, so its time for me to answer some...

    yes, definitely get a report from them. dont let them tell you they cant. they tried that crap with me. tell them that since your check was denied, you are entitled to a free report.

    also, i doubt walmart is the one reporting this. its probably a bank. in my case, it was a bank that i had never had an account with. this could be what's happening with you... the bank thinks you had an account with them and wrote a bad check.

    curiously, my supposed 'debt' with my mysterious bank was in 1999 also....

    any more questions? fire away, lol...

    WAL*MART said they DON'T have anything on you...then it is a TELECHECK PROBLEM!!!

    ok guys - i am ready to flip out hardcore, so please put me back in check.

    today i went to the little corner store i have been goint to for 8 YEARS, wrote a check like i do every time - the last of which was YESTERDAY and had no problems. Today I get declined. Thank god I know them and they took my check anyways.

    So I get home and call telecheck. get some underpaid CSR named michelle with an attitude the size of Texas (sorry for those who live in texas) who REFUSES to give me a copy of my report since telecheck isn't the CA for WALMART. so then i proceed to ask how long this check has been in their database and why it is just now affecting me. this B*tch just keeps telling me to call walmart. i explained that walmart doesn't have me in their system, so i would like to see what telecheck is reporting on me. she REFUSED to let me talk to a supervisor to expedite the correcting of this.

    so now walmart has no info on me, telecheck won't give me a copy of the report...WHAT DO I DO NOW?

    Telecheck may or may not be collecting the check but they ARE a CRA, and thus, covered by FCRA.

    Demand your report.

    Memorialize & Mail to telecheck.

    Hint, or flat out ITS if you want.

    Michele violated the FCRA by refusing to issue a copy of your company's report to you, the consumer, when you were the victim of an adverse action based on information in your company's consumer reporting agency report.

    Michele willfully & knowingly violated the FCRA, and neglegently violated the FCRA in refusing to issue a copy of your consumer reporting agency report from your company.

    Also file complaint with FTC and your state AG against Telecheck. Make their violations visible.

    arghhhhhhh!

    i had no internet connection over the weekend! Major withdrawal symptoms, AND this thread was on my mind the whole time.

    ok, the same thing happened to me. Did you read my thread? The guy tried to tell me that since THEY werent the collector, they didn't have to provide a report. I told him that since they were a CRA, and that my check was declined because of incorrect information they were reporting, I was ENTITLED to a free report. He put me on hold forever, and finally got my info & sent me a report. Call again and get a different CSR. Even if they've violated the FCRA, even if you can sue at this point....You need that report!

    I can't stress how important it is too keep your cool and be nice and 'dumb' with these people.

    after you get the report, dispute the information...and wait for them to NOT verify in 30 days.

    then, you'll have them on yet another violation, because they probably won't remove the incorrect info.

    oh oh! i forgot! the first time I called and figured out how to talk to a 'real person' at telecheck, the CSR told me I needed to talk to Walmart too! this was probably because I had just had a check declined there, and the little code # on that teeny little slip of paper they give you at the checkout probably indicated that the transaction happened at Walmart. of course, walmart had NO record of me (as far as writing a bad check or owing them any money) in their database.

    Simply speaking, the CSRs at Telecheck are CLUELESS, and this can be used to your advantage!!

    first things first....put up with not being able to write checks, and do what you gotta do to get that report.

    Save every receipt for every time you have to use a credit card, withdraw money from an ATM or the bank, and especially when your checks are declined!

    Make copies of the receipts, in case they're written with that ink that 'disappears' over time.

    I know its frustrating, but this *could* be worth it in the end. ;)

    get your report, and go from there.

    thanks everyone.

    the most frustrating part is that my dryer ate my debit card and i am waiting on that. PLUS the nearest branch for my bank is 30 miles away (i don't work at a branch)...

    so i called again and got another underpaid CSR who now states that every merchant that uses telecheck MUST use another source to verify the check (its the law, he tells me!) so that i should get my report from them since it isn't in their policy to give consumers their reports. i *very calmly* explained that in order for me to resolve this I need a copy and he says to me "that isn't our problem, your the one that bounced the check".

    i am at my wits end. should i ITS them for not giving me my report?

    you are kidding me. how in the H are you supposed to get a TeleCheck report from a merchant? am i understanding you correctly? what the?

    I wish I knew what i said that made them realize they were to send me a report. This is obviously tougher for you for some stupid reason. I guess you could call the lady who's number I have....she's pretty nice (if youre nice to her, lol) but she is not very knowledgeable, so I don't know if you'd get any further with her.

    Also, I believe calling her would spoil things, if you know what i mean...

    If they have a hint that you know anything about FCRA, your rights, etc, they won't be as likely to screw up. on the other hand, if they know that you know all this, and are ready to sue, they'll probably investigate the way they're supposed to and you never know, they may actually delete the info and let you write checks again. which is good, because, maybe that's your only goal here.

    so depending on what you want out of this, you have a couple of choices to make.

    If this was me, and I just could NOT get anywhere over the phone, I'd write a letter asking for my report and see if you get their 'sorry, no dice' response in the mail. then you've got a tangible violation. OR you could actually get your report, which will list the entity you owe this 'debt' to.

    btw, do you live in a 1-party state? if so, get a phone recording device. mine has come in really handy for more than just this telecheck thing.

    Telecheck must have an address to request reports. They are a CRA, and are required to follow FCRA. Since you are owed a report for having your check declined based on their erroneous information, request your free report in writing, CRRR, including identification so they have no legitimate reason to refuse.

    If they fail to respond, or reply in writing that they don't have to, you are ready to go after them. If you can't find their address to send the request to, call FTC. They should be able to provide it. Otherwise send it to their agent of service in your state. You might include in your letter that their CSRs refused your request, to start documenting their violations, and note CC: FTC at the bottom, while sending a copy with a complaint to FTC.

    If, after the initial request to correct, a company acts illegally, in bad faith, or incompetantly, with damage to you, proceed assuming that push will have to become shove. Your error will not get fixed by itself.

    Click Business, and type their name...

    There are a lot of entries...

    Look for all the ones which have the BBB MEMBER icon on them :)

    There are two major ones -- Atlanta GA & TX :)

    Send the dispute to those addresses & the contact name & address listed on there

    TeleCheck
    Attn: Name

    The reason I suggest this, is if they do fumble and you need to supplement your papertrail through the BBB, the BBB will notice that you sent everything to their contact. AND since these are the main offices & BBB members, they are required to respond to disputes through the BBB within a set period of time.

    ok - i called and asked for an address and they DENIED me! they said they don't give out their address for report requests (I must be flagged in their system now or something).

    so i am just going to write to their headquarters address listed on their website. anyone have any good letters?
