I used at similar letter (at Bill Bauer's suggestion), and had good results. They really don't know what to do with a paid account who starts harrassing them two years later. I got a call from a CA on Dec. 14th. He's says, "What do you want from me? You paid, we're reporting it as paid, what the heck do you want?" I said, "It's all in the letters (he had gotten a similarly modified estoppel letter also), and, BTW, as per the letters, all further correspondence, and there will be further correspondence, will be in writing."I hung up. As the handset was moving toward the receiver, I heard him yell, "What do you want from me???" I smiled. Big. On Christmas Eve, I get a letter from this same bozo, saying my account with them has been "cancelled", and the CRA's will be directed to remove it from my credit profile. It hasn't worked every time, but it has worked.
Psydoc's letter & paid validation? What laws apply to CA's that report paid chargeoffs? There must be some law? Are they free to report anything and not validate?
Hello, Would you recommend the paid collection letter you mentioned for a paid charge-off? I don't want to send something and sound like I don't know what I'm talking about. Anyway, I have two charge-offs that I paid 2 1/2 years ago and I recently contacted the OC requesting deletion from my CR. The amounts were Belk $97.00 and Mervyns $39.00. I am ashamed. I figure that with those dollar amounts that has to be late fees, finance fees, etc. I'm sure it's not from purchases. (If I didn't pay for 3 months or whatever and was charged $25.00 delq fee then that would make up those balances.) Anyhow, Belk said it was against their policy-wouldn't even consider it and Mervyns said I should have requested it when I paid the balance. Well, I didn't know I could do that then and what is the difference between now and 2 1/2 years ago anyway? She said she would check and let me know but I haven't heard anything as of yet. They were at least willing to 'listen'. Thank you for any advice you may have. HeatherB
Doc's litigious nutcase letter was designed for fully-paid charge-off accounts with OC's I believe, so yes, this would be the letter you would use for those two paid c/o's. The letter, from what I remember, makes you sound like a nutcase who will sue at the drop of a hat, and all you're looking for is deletion of the tradeline in question.
I sent a letter similar to Sears regarding an unpaid charge-off offering full payment. I have not heard from them yet. ANY updates since this thread began????
Yep, Diane, I think I mentioned this in another thread (so you should set about the task of reading all several-hundred-thousand messages, LOL). I did get the goodwill adjustment I requested from Sears. It took them about 5 weeks to do it, though. If you request such dispensation, remember to use the address they designate specifically for such requests; otherwise it may get lost or ignored by their staffers who aren't even aware they consider such case-by-case requests: Sears NAAC Attn Credit Bureau Desk 13200 Smith Rd. Great I will reword my letter I already sent . Do you think they will consider a "good-will " adjustment in my case? (unpaid present charge off but will be payed in full?)
Here's a true nutcase approach that just came to mind; After sending the "nutcase letter" CMRRR, every single day send the following follow up letter: Dear xyz Corp, This is a reminder that you only have 29 out of thirty days remaining to take action on the notarized letter (copy enclosed for your convenience) which I sent to you on june 3rd via certified mail. I am looking forward to a conclusion to this matter that doesn't require me to enforce my rights protected by law, both civil and criminal. Sincerely Bob Whackjob And once you begin sending subsequent letters you could add copies of ALL previous letters. Also, throw in copies of any "return receipts" along with their respective letter copies once you begin to receive them. Within two weeks your paid off CA will be receiving a daily manila envelope from you showing just how on top of this matter you really are. I don't know about how thick your skin is, but this approach would certainly get a quick self preservation response out of me.
If you try this approach and follow up with complaints to the better business bureau and the attorney generals office you may have better luck.
