I DV'd a CA and received some paper work in the mail. The paperwork arrived after 4 weeks after my first request for validation. Missing is the signed agreement between the OC and the CA and th signed agreemnet between myself and the OC. Additionally, the CA has not listed the account as 'in dispute' on my CRA's. I am going to send out the third letter - demanding the account be removed from my CRA's as they have not properly/completely validated the debt. Do I have to state the validation that is not included and wait for another response? Or can I expect them to remove the tradeline as it has been 5 weeks since they first received my request?
They are not required to send you any agreement between the OC and CA, regardless if requested or not. They can provide an affidavit showing they own the account and that will be sufficient. The account should have been listed under FCRA as disputed. The CA is required to cease collection efforts until the dispute has been resolved, there is no time limit on this. You should reply back to the CA advsing them you are requesting a signed copy of a contract bearing your signature.
But if it goes to court, they better have something in writting or is will be tossed out as the contract is between you and the OC and not the CA, actually have have no authority to collect it if they do not have some agreement with the OC. That would be like me trying to collect someone on you. You can get a CA license in a bag of chips, that is about all is required and the oath you will break the law, lie, cheat, steal and corrupt just to get money from someone. Never trust a CA, they are "all" scum.
All they are required to provide is the affidavit showing they have control of the account, no contract between the OC and CA is required. Never trust a debtor, they lie steal and cheat. Sound familiar?
