the CA was very rude!!!

    Ok...the CA is not on the current copy of my credit report...I'm guessing that in order to validate this with the CBs I can write them a letter stating my problem?? And no I've never received anything in writing from the CA...NEVER

    let me see how to explain this in simple terms.

    there are many ways accts are reported.

    good paid etc etc

    late 30, 60, 90 days etc

    closed
    charged off and the DOD date of deliquency

    this acct sounds like it is just past due but can go into a charge off rather quickly.

    My advise write a letter to the Original creditor and include a payment so that they can not charge off this acct,

    in you letter send it CMRRR certified mail return reciept requested from the post office it costs a few $ but this ensures that they recievd your letter you put this tracking # on your letter before you mail it and keep a copy of this letter for your records.

    U will get a green card back in the mail with a signature on it keep this for your records.

    are you still getting statements for this acct from the creditor?

    if so do you agree with the balance if yes try to make payment arrangements with the creditor if your answer is no and this account is listed on your credit report I would dispute this acct with the CRA credit reporting agencies. and let them investigate the acct, if it comes back verified let us know well help you from there.

    What does CMRRR stand for...regular certification? No, I am not receiving statements on this account nor can I log on to see it online.....I received a letter last month regarding the fact that it was closed but only discussed the fact that I was no longer able to use the credit protection product on it anymore. This letter was from the OC....I have never received anything from the CA.
    I'll send a letter to the OC with a payment. What do I do about the letter of validation I've sent to the CA...am I supposed to wait for a response first from the CA and then send the OC a letter and payment...or go ahead and do that now and request a payment plan or something?

    Should I send a letter to the CA about their conduct and apparent assumption that I have just thrown away or denied ever receiving anything from them in the mail or that alleged email they claimed to have sent me. I just feel that perhaps doing so would atleast keep a paper trail and documentation that they are aware of their behavior and may from now on walk on egg shells...???? Just a thought. Please advise.

    you could i guess, but thats what the phone call memorialization is for.

    You say the CA has never written you. they claim they have. did you ask them what address they were sending their letters to? have you moved recently?

    Have they ever given you the 'mini-miranda' over the phone?
    (mini-miranda=the statement that "this is an attempt to collect a debt, and any info obtained will be used for that purpose...you have 30 days to dispute in writing, or we will assume the debt is valid...bla bla")
    -I personally would not send a cease and desist, because they very well may sue you. also, by leaving the lines of communication open, you can get them for 'continued collection activity' when they call and request payment after they receive the validation request, before they validate.

    -it will say 'charge off' on your CR if its a charged off account. if it was 90 days past due when it was closed at the end of march, then its almost 120 days past due now. they usually dont charge things off until the 180 day mark. Note: i said 'usually'.

    -you could send a validation letter to the OC, but OCs arent bound by the law in that regard (FDCPA). Instead, send a dispute letter to the OC, and explain that you are being contacted by a CA, but you don't think the account has charged off, and you are willing to resume payments to them (the OC) if they will tell the CA to back off, (whats that term for when an OC takes an account back from a CA? retract?) and if they will send an explanation of the status of the account. A "90 days past due" notation on your CR is bad, but its better than a chargeoff and subsequent collection TL. if the rest of your credit really is 'otherwise perfect' it shouldnt hurt you too bad.

    -as far as talking to them on the phone, I find it a source of entertainment, actually, lol. but dont get nasty with her. let her get all upset instead. READ READ READ this board so that you are prepared for the things she says. she will try to get you to admit this is a valid debt. After you get the green card back in the mail, which means they have your validation request, by all means answer the phone and ask her why she is calling so that she'll say 'to collect a debt/make payment arrangements' and you can log that as "violation #1". If you get sick of the calls, let your answering machine tape the violations.
